1. general

Please read these terms of use carefully before accessing or using the search function. By accessing or using the website, you agree that you have read and understood the terms of use and that you agree to them.

The Search is a web-based service owned and managed by AbbVie (including its affiliates). It allows you to search for your nearest medical aesthetic practice and also displays contact details (the “Search”).

AbbVie provides this service to you for the sole purpose of promoting access to appropriate medical standards and practices and thus supporting the need for accurate, balanced and independent information and advice on facial treatment options.

You are aware that the Search lists medical practices that have been verified by AbbVie as AbbVie customers. This means that AbbVie has verified the individual physicians and/or practice licenses. All medical practices listed are under no obligation to purchase AbbVie products. Inclusion in the Search is completely free and is subject to each individual physician and/or physician practice’s agreement and consent to have his/her information displayed in the Search.

Use of the Search is free of charge for you. The individual doctors and/or medical practices that are included in the search do not pay any fees to AbbVie for this service.

The Search does not constitute a form of partnership, co-marketing or co-promotion between AbbVie and the individual physicians and/or medical practices.

The information contained in the Search does not constitute an offer to sell or a solicitation for any product or service offered by AbbVie or by AbbVie customers or third-party medical practices using AbbVie products.

2. use

You will use the Search in a manner consistent with all applicable laws, rules and regulations. If you violate any restrictions in these Terms, you agree to indemnify AbbVie for all losses, costs or damages, including reasonable attorneys’ fees, incurred by AbbVie in connection with or arising out of such violation.

3. exclusion of warranties

You agree that the Search is provided “as is” and “as available.” AbbVie disclaims all warranties of merchantability, fitness for a particular purpose, freedom from computer viruses, and non-infringement with respect to the Search to the fullest extent permitted by applicable laws and regulations.

You understand and agree that AbbVie, by listing individual physicians and/or medical practices (including their staff and employees) and/or by publishing information relating to such physicians or practices, does not recommend, certify, evaluate, promote, endorse, or otherwise advise you to consult or utilize the services of any particular physician or practice. Nor does AbbVie thereby recognize or suggest that any of these physicians or practices are necessarily qualified, capable, or trained to provide you with the medical treatments or results you expect.

AbbVie only recommends that you discuss your medical aesthetic interest in facial injectable treatments with qualified professionals and ensure that you have obtained sufficient and satisfactory information before making a decision about your treatment.

4. risk

The entire risk in connection with the use of the Search lies with you. Access to and use of any information and/or other content you may come across while using the Search is at your own risk and you are fully responsible for any costs, damages, losses or claims you may incur as a result of using the Search.

5. liability

You understand that AbbVie relies on the representations of third-party medical practices and/or individual healthcare professionals as to the accuracy of the information provided in the search. AbbVie therefore disclaims any liability with respect to the accuracy and reliability of such information, and therefore you will be liable for any direct or indirect, special, incidental or consequential loss of profits, revenue, contracts or goodwill resulting from any errors or omissions in the information provided in the search.

6. exclusion of liability

AbbVie shall not be liable for any direct or indirect, special, incidental or consequential loss of profits, revenue, contracts or goodwill arising out of or in any way connected with the availability or unavailability of the Site or with any interruption of service, computer failure, computer virus, loss of data or otherwise arising out of the use of this Site. To the extent permitted by law, AbbVie excludes all liability for any errors or omissions in the information, materials or functions of the search and any liability for negligence. Nothing in these Terms excludes our liability for death or personal injury caused by our negligence or by AbbVie’s fraudulent misrepresentation.

7. removal of material contained in the search

Although AbbVie assumes no responsibility for monitoring or editing material posted in searches, AbbVie reserves the right to take appropriate action in its sole discretion to edit or, if necessary, remove such content when it is notified of inappropriate content or materials.

8. copyright

Copyright in materials and/or content in the Search is owned by or licensed to AbbVie and protected by the copyright laws of Ireland, international copyright treaties and all other applicable copyright and intellectual property laws.

9. data protection

AbbVie complies with the General Data Protection Regulation and all other applicable data protection laws, and any personal data voluntarily provided to AbbVie through the Search will be processed in accordance with its Privacy Policy. You are not required to provide AbbVie with any personal data in order to use the Search. However, we encourage you to read the privacy policy of the AbbVie website that contains the search.

10. termination

Your access to and use of the Search may be changed, restricted or terminated immediately by AbbVie at any time and for any reason.

11. severability clause

If any part of these Terms of Use is held invalid for any reason by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining portions of the Terms. All other parts shall remain in full force and effect as if the invalid part of the Terms had been removed.

12. changes

AbbVie reserves the right to change the Search and the terms and conditions for its use at any time without prior notice. By accessing and using the Search, you are automatically bound by any such changes and should therefore periodically visit this page to review the current terms and conditions.

13 Governing law and jurisdiction

The Search shall be operated in accordance with the laws and regulations of Ireland. You agree that the Irish courts will have jurisdiction over any dispute or claim arising out of or in connection with your use of this website. The website is intended for use by residents of Switzerland and Austria, although it may be accessed by users outside that country.
